Terms and Conditions

Last updated: November 4, 2026

These Terms and Conditions govern your use of the game RATSTAURANTS (the “app”) on iPhone, iPad, computer and browser, offered by Enrique Martorell Fernández, based in Mexico (the “provider”, “we” or “us”). By downloading, installing or using the app, or by creating an account, you accept these Terms and the Privacy Notice. If you don’t agree, don’t use the app.

1. Who can use the app

The app is for all ages. You must be at least 13 years old to create an account. If you are under 18, you need permission from your parent or guardian to create an account and to make purchases; they are responsible for your use of the app. On iPhone and iPad, purchases can be controlled with Apple’s features (for example, Family Sharing’s “Ask to Buy”).

2. Your account

You can play without an account; in that case your game is saved only on your device and may be lost if you delete the app or its data. With an account (email and password) your game is saved in the cloud and you can keep playing on another device. You must use your own email and confirm it, keep your password secret and tell us if someone gets into your account without permission. You are responsible for what is done with your account. Accounts are personal: they can’t be sold, lent or transferred.

3. License

We grant you a personal, limited, revocable, non-exclusive and non-transferable license to use the app for entertainment and non-commercial purposes. The app, its name, logos, artwork, characters, music, texts and code belong to the provider or its licensors and are protected by intellectual property laws. You may not copy, modify, sell, rent or decompile the app, try to obtain its code or create derivative works, except as expressly allowed by law.

4. Community rules

Some parts of the app are seen by other players: your restaurant’s name, your chef’s name and look, your restaurant, and your visits, infestations and reviews (stars and comments). You agree not to:

We may delete or change content that breaks these rules and suspend or close accounts that break them, with or without notice, depending on how serious it is.

5. What you write

The names and comments you write are still yours, but you give us a free, worldwide, non-exclusive permission to store them, show them to other players inside the app and adapt them (for example, translate or shorten them) for as long as your account exists, only so the game can work. You are responsible for what you write.

6. Game money, truffles and purchases

Game money, black truffles and everything you buy inside the game are virtual items: they only work inside the app, they are not real money, they have no value outside it, they can’t be exchanged for money or prizes, and they can’t be sold or moved to another account. You hold a license to use them, not ownership.

Some truffle packs can be bought with real money. On iPhone and iPad, payment is handled by Apple through your Apple account and under its terms; we never receive your card details. Prices are shown in the app before you buy and include any taxes Apple applies in your country. Purchased truffles are added to your game right away. Refunds are requested from Apple (reportaproblem.apple.com) under its policies; if Apple issues a refund, we may remove the matching truffles from your game. This doesn’t limit any rights you have under Mexico’s Federal Consumer Protection Law or other applicable law.

We may change prices, amounts, rewards and game balance (for example, prices in the game shop or mission rewards) to improve the game; such changes don’t entitle you to compensation.

7. Ads

The app may offer optional video ads (for example, from Google AdMob) in exchange for in-game rewards. Watching them is voluntary. We are not responsible for the content of the ads or for third-party products or sites that are advertised.

8. Changes, bugs and availability

The app is provided “as is” and “as available”. We do our best to make it work well, but it may have bugs, outages or data loss, and it depends on the internet and on third-party services (such as Apple and Google). We may update, change, pause or stop offering the app or some of its features at any time. We recommend using an account so your game is saved in the cloud.

9. Limitation of liability

To the extent permitted by law, the provider is not liable for indirect damages, loss of data or saved games, or for failures of the internet, your device or third-party services. If we are found liable for anything, our total liability is limited to what you paid for in-app purchases in the previous 12 months. Nothing here limits rights that cannot be waived under the law.

10. Termination

You can stop using the app whenever you want, log out, delete your game (Local › Game › Start over) and delete your account yourself from the app (Local › Game › Delete my account) or by asking us at cocinaly@cocinaly.com. We may suspend or close your access if you break these Terms. When an account is closed, the game and virtual items are lost, without a refund, except as required by law.

11. If you downloaded the app from the App Store

These Terms are between you and the provider, not Apple. Apple is not responsible for the app or its content, has no obligation to maintain or support it, and is not responsible for claims about it (for example, product, legal compliance or intellectual property claims); those claims are handled by us. If the app fails to meet any applicable warranty, you may notify Apple, which may refund the app’s purchase price, if any; beyond that, Apple has no other warranty obligation. The App Store terms of use (Apple’s Licensed Application End User License Agreement) also apply. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You represent that you are not located in a country subject to a U.S. embargo and are not on any U.S. list of restricted parties.

12. Governing law and changes

These Terms are governed by the laws of the United Mexican States. Any dispute will be resolved before the competent courts of Mexico, without prejudice to your right to go to the Federal Consumer Protection Agency (Profeco). We may update these Terms; the current version is always in the app, with its date. If the change is important, we’ll let you know inside the app. If you keep using the app after a change, you accept it.
